JEPPESEN GMBH’S RIGHT TO RETURN POLICY FOR CONSUMERS

This right to return only applies to you if you are a Consumer. You are a Consumer hereunder if you contract with us as a private individual for a purpose that is outside your trade, business or profession and you have your habitual residence within the territory of the European Union (hereafter “Consumer”). As a Consumer, you have the right to return the received goods/products without stating any reasons within a period of one (1) month. The stated time period begins at the earliest with the receipt of the goods/products and this return policy. The right of return can only be exercised by returning the goods/products to Jeppesen GmbH, Return Department, Rathenaustr. 15, 63263 Neu-Isenburg, Germany. Timely dispatch suffices to comply with the time limit. The cost and risk of return shall be borne by Jeppesen. The above right of return shall not apply to the delivery of goods/products made to your specification, or clearly personalized, or which, by reason of their nature, cannot be returned, or are liable to deteriorate, or expire rapidly, or where the recommended period for their consumption would be exceeded (e.g. Trip Kits and/or aeronautical information products that are effective for less than a one (1) month period). Neither shall the right of return apply to the delivery of audio, data and/or video recordings or of software in the event that their data carriers have been unsealed by you.

 

Legal Consequences

In the case of the right of return being rightfully exercised, you must return any goods/products received and all benefits derived from such goods/products (e.g. from usage) and Jeppesen will refund the received consideration of such goods/products. Jeppesen shall have a right of compensation for value in respect of deterioration in the goods/products as a result of their proper use. This shall not apply if the deterioration is exclusively due to the inspection of the goods/products – as would have been possible in a shop. The obligation to compensate Jeppesen will be avoided, if you refrain from using the goods/products like an owner and from all actions that cause any deterioration of the goods/products. This does not affect your statutory rights under the applicable law.
